Terms of Service
These Terms of Service outline the agreement between you (the “Client”) and Exotic Bathroom Renovations (“we”, “us”, or “our”) for the provision of renovation and restoration services. By accepting a quote or engaging our services, you agree to the following terms:

1. Definitions
1.1. ​​We” and “Us” mean, and “Our” refers to, Exotic Bathroom Renovations (ABN [677 812 252)
“You” and “Customer” mean, and “Your” refers to, the person or entity who requests Goods and/or Services from Us
1.2. “Goods” means any products or materials supplied to You, whether by Us or third parties
1.3. “Services” means all labour and renovation works performed by Us or subcontractors on Our behalf
1.4. “Renovation Works” includes demolition, waterproofing, tiling, plumbing, fixture installation, painting, and related services
1.5. “Quote” means the estimated Cost of Goods and/or Services
1.6. “Commencement of Work” means when You approve a Quotation and We confirm, or when work begins, whichever is earlier
1.7. “Completion of Work” means when all quoted Services and Goods have been delivered for a particular order
1.8. “Site” means the premises where the renovation works are to be performed
2. Terms of Engagement
2.1. These Terms apply to all work performed by Us.
2.2. Any verbal or written quotation accepted by You is subject to these Terms.
2.3. These Terms override any prior agreements unless expressly agreed in writing.

3. Quotations
3.1. A quote is not a binding offer. Approval by the Client constitutes an offer, which We may confirm or revise.
3.2. All quotes provided are valid for 30 days from the issue date unless otherwise agreed.
3.3. The scope of Goods and/or Services will be as outlined in the Quote, which is based on information and specifications provided by You.
3.3.1. The scope of Goods and/or Services may change if unforeseen issues arise during the works, including but not limited to hidden water damage, mould, asbestos, faulty plumbing, or structural concerns.
3.3.2. Any required changes will be discussed and quoted separately before continuing.
3.4. A site inspection is usually required before finalising a quote. Estimates provided without a site visit are indicative only.
3.5. Any variation to the original quote must be approved in writing and may incur additional charges.
3.6. Prices may be adjusted prior to confirmation due to supply costs or availability.
4. Booking, Deposit & Payment Terms
4.1. A deposit of 25% is required to secure your booking for Renovation Works.
4.2. Bookings are not confirmed until the deposit is received.
4.3. Full payment is required upon completion of the Renovation Works unless otherwise agreed in writing.
4.4. We accept payment by EFT, cash, or PayID (at our discretion).

5. Cancellations & Rescheduling
5.1. If the Client wishes to cancel a request for Goods and/or Services, You must let Us know as soon as possible in writing.
5.2. Cancellations made less than 5 business days before the scheduled start date may forfeit the deposit.
5.3. Rescheduling is subject to availability and must be requested in writing.
5.4. The Client will remain liable for the Cost of any Goods and/or Services which:
5.4.1. Have already been supplied to You; or
5.4.2. Have already been ordered or procured in order to provide to you, if we are unable to cancel such an order and do not reasonably expect that we can use or sell those Goods and/or Services to another customer; or
5.4.3. Are non-refundable items or subcontractor bookings.

6. Site Access & Risk
6.1. The Client is responsible for ensuring clear and safe access to the worksite.
6.2. All personal items, furniture, and valuables must be removed from the work area prior to commencement.
6.3. The Client agrees to vacate or restrict access to the work area during Renovation Works.
6.4. If demolition is involved, noise, dust, and disruptions are to be expected.
6.5. We are not liable for injury to persons or pets due to unauthorised entry to the Site.
7. Hidden Conditions & Unforeseen Issues
7.1. We are not liable for delays or costs arising from hidden conditions such as:
7.1.1. Mould, asbestos, or water damage;
7.1.2. Plumbing or electrical faults;
7.1.3. Structural issues or previous non-compliant work.
7.2. If such issues are uncovered, the Client will be advised and a revised quote may be provided.
8. Work, Licensing & Compliance
8.1. All plumbing, electrical, and waterproofing is performed by licensed and insured professionals.
8.2. All waterproofing complies with Australian Standards (AS 3740) and relevant codes. Certificates are available upon request.
8.3. We do not accept liability for work modified by others post-completion.
9. Insurance & Licensing
9.1. We are fully insured and comply with all relevant NSW building and trade requirements.
9.2. Subcontractors engaged hold the required licences for specialised work.
10. Product Supply & Warranties
10.1. Fixtures, tiles, and fittings can be supplied by us or the Client.
10.2. We are not responsible for delays or faults in Client-supplied products.
10.3. Manufacturer warranties apply to all materials and products used. Workmanship is covered by a 5-year warranty, subject to proper use and care.
11. Payment Terms
11.1. Payment terms are as follows (unless agreed otherwise in writing):
25% deposit on booking
40% progress payment after demolition and waterproofing
35% final payment upon completion
11.2. Payments must be made within 7 days of invoice. Late payments may attract interest or delay warranty release.

12. Completion & Defects
12.1. The Client must inspect the work upon completion and notify us of any defects within 5 business days.
12.2. We will rectify any genuine defects within a reasonable timeframe.
12.3. Minor touch-ups or cosmetic imperfections that fall within acceptable trade tolerance will not be considered defects.
13. Limitation of Liability
13.1. Consumer protection legislation (including the Competition and Consumer Act 2010 (Cth) and State/Territory fair trading legislation) may imply other terms, conditions or warranties (“implied terms”) into our relationship with you that cannot be excluded or can only be excluded to a limited extent.
13.2. These Terms do not exclude any liability under, or modify the application or exercise of, such implied terms where legislation voids or prohibits any such provision.
13.3. Where permitted by law, Our liability for any breach of such implied terms shall be limited, at Our option, to any one or more of the ways permitted by the legislation, including:
13.3.1. In the case of Goods:
(a) the repair of the Goods or payment of the cost of having the Goods repaired; or
(b) the replacement of the Goods or payment of the cost of replacing the Goods; or
(c) ​the supply of equivalent Goods or payment of the cost of acquiring equivalent Goods;
13.3.2. In the case of Services:
(i) the supplying of the Services again; or
(ii) the payment of the cost of having the Services supplied again.
13.4. We are not liable for:
13.4.1. Damage caused by existing conditions (e.g. pre-existing leaks or structural issues);
13.4.2. Client-supplied products that fail;
13.4.3. Delays due to weather, supply chain issues, or access restrictions
13.5. Subject to these terms and to the extent permitted by law:
13.5.1. We do not make any representation, warranty or endorsement of any kind as to the Goods and/or Services, including but not limited to the fitness of the Goods and/or Services for a particular purpose;
13.5.2. We will not be under any other liability in respect of any loss or damage (including consequential loss, economic loss, loss of profits or damage) however caused (whether by negligence or otherwise) which may be suffered or incurred, or which may arise directly or indirectly in respect of any Goods or Services.

14. Photography & Marketing
14.1. We may take photos and/or videos of Works in progress or completed work for marketing purposes. No identifying content of the Client will be published without consent.
14.2. You may opt out of this by notifying us in writing before Completion..
15. Disputes & Resolution
15.1. We aim to resolve all disputes quickly and professionally. If an issue arises, the parties agree to first attempt resolution in good faith.before taking further action.
15.2. If not resolved, disputes may be referred to NSW Fair Trading or an appropriate tribunal.
16. Governing Law
16.1. These Terms are governed by the laws of New South Wales, Australia.
